These Terms and Conditions of Use (“Terms”) govern the purchase of, enrolment in, access to and participation in the online courses, recorded programmes, live workshops, cohort programmes, memberships, communities, sessions, learning materials and related services offered under the name “Reinvent with Ashish Vidyarthi”.
The Offerings are provided by Ashish Vidyarthi and Associates LLP, a limited liability partnership incorporated under the Limited Liability Partnership Act, 2008, having its registered/principal office at 213, Yugdharma, Opp. Inorbit Mall, Malad Link Road, Goregaon West, Mumbai – 400104, Maharashtra, India, and operating under the brand “Avid Miner” (the “Operator”, “we”, “us” or “our”).
Ashish Vidyarthi may act as the lead instructor, content creator, performer and/or presenter for certain Offerings. He is not personally the contracting seller, operator of the TagMango Platform or provider of the Offering unless the applicable Course Page, invoice or order document expressly identifies him in that capacity.
In these Terms, unless the context requires otherwise:
“Applicable Law” means any statute, rule, regulation, notification, order, binding governmental requirement or judicial direction that applies to the relevant party, transaction, Offering or activity, including the laws of India and any mandatory, non-excludable law applicable to a Purchaser or Participant, but only to the extent that such law applies.
“Business Day” means a day other than a Saturday, Sunday or public or bank holiday at the Operator’s registered or principal place of business.
“Course Content” means all content owned by or lawfully licensed to the Operator, Ashish Vidyarthi or another relevant rights holder and made available in connection with an Offering, including videos, audio, live or recorded sessions, performances, scripts, stories, course structures, presentations, text, graphics, exercises, methods, quizzes, assessments, photographs, recordings, workbooks, templates, frameworks, trademarks, logos, and other learning resources. Course Content does not include Participant Content.
“Course Page” means the applicable sales, registration or information page describing a particular Offering, together with the Offering-specific information expressly displayed at checkout before purchase.
“Downloadable Materials” means any Course Content capable of being downloaded, exported, copied or retained separately from the TagMango Platform, including PDFs, templates, frameworks, workbooks, exercises, presentations, audio files, recordings and similar resources.
“Offering” or “Offerings” means any online course, recorded programme, live workshop, cohort programme, membership, community, session, learning material or related service offered under the name “Reinvent with Ashish Vidyarthi”.
“Operator” means the legal entity identified above as the seller and provider of the relevant Offering. The term does not include TagMango or Ashish Vidyarthi personally unless the relevant entity or person is expressly identified as the seller on the applicable invoice or order document.
“Participant” or “Learner” means the individual authorised to access or participate in an Offering, whether or not that individual is also the Purchaser. A person under eighteen may be a Participant only in accordance with Section 3.
“Participant Content” means original questions, comments, assignments, responses, feedback, posts, messages, recordings or other material submitted or contributed by a Participant in connection with an Offering.
“Payment Service Provider” means any bank, card network, card issuer, UPI provider, payment gateway, payment processor or other third party involved in authorising, collecting, settling, converting, reversing or refunding a payment.
“Purchaser” means the legally competent individual or entity that places an order or pays for an Offering. A Purchaser may purchase an Offering for themselves or for another eligible Participant.
“Recurring Subscription” means an arrangement under which fees for continued access to an Offering, membership or community are charged automatically at the frequency disclosed before purchase until the subscription is cancelled or terminated.
“TagMango” means TagMango Private Limited.
“TagMango Platform” means the websites, mobile applications, account systems, technology infrastructure and related digital services operated or provided by TagMango through which an Offering may be hosted, purchased, accessed or delivered.
“Written Confirmation” or “confirmed in writing” means confirmation issued through an official Operator email address, an Operator-authorised notice delivered through the TagMango Platform, a document signed by an authorised representative of the Operator or another verifiable written communication issued by such representative. A statement made by an instructor, guest, moderator, community member, affiliate or other person will not vary these Terms unless that person is authorised to do so and the variation is confirmed through one of these methods.
References to “you” or “your” mean the Purchaser and/or Participant, depending on the obligation or right concerned. Where the Participant is under eighteen, those references include the parent or legal guardian accepting these Terms, while behavioural, access, community and content-use requirements also apply to the minor Participant as appropriate.
These Terms, the applicable Course Page, the order summary and any additional Offering-specific conditions expressly disclosed before purchase constitute the agreement between the Purchaser and the Operator for the relevant Offering.
The Privacy Policy is a separate notice explaining how personal data is handled. Any consent required for a particular data-processing activity will be requested separately where required by Applicable Law.
By selecting the acceptance checkbox and placing an order, the Purchaser confirms that they have read and accepted these Terms. Where an adult Participant is different from the Purchaser, the Operator may require the Participant to accept these Terms before receiving or continuing access. Where the Participant is under eighteen, acceptance and responsibility will be governed by Section 3.
The Course Page will control Offering-specific commercial details expressly disclosed before purchase, including the price, currency, schedule, access period, principal inclusions, eligibility requirements and any Offering-specific refund condition. These Terms will control general access, conduct, intellectual-property, liability and dispute provisions. A variation will override these Terms only where it is clearly and prominently disclosed for the relevant Offering before purchase and is not prohibited by Applicable Law.
2. Relationship With TagMango
The Offerings are hosted and made accessible through the TagMango Platform. TagMango may provide or facilitate account creation, authentication, content hosting, community features, notifications, payment-processing interfaces and other technical functions.
Your access to and use of the TagMango Platform are also subject to TagMango’s then-applicable Terms and Conditions available at https://tagmango.com/terms and Privacy Policy available at https://tagmango.com/privacy. You should read those documents because they govern TagMango’s platform services and TagMango’s own processing of personal data.
These Terms govern the contract between you and the Operator for the Offerings. TagMango’s terms govern your use of the TagMango Platform and its technology functions. Nothing in these Terms modifies TagMango’s terms. If there is a conflict concerning a matter relating specifically to the use of the TagMango Platform, TagMango’s terms will apply to that platform-related matter. These Terms will continue to govern the Operator’s Offerings, subject always to Applicable Law and rights that cannot lawfully be waived.
3. Eligibility and Authority
You must be at least eighteen years old and legally competent to enter into a binding contract under Applicable Law to independently create an account, purchase an Offering or agree to these Terms.
A person under eighteen may participate only in an Offering that is expressly stated to be open to minors. The purchase, registration and account access for such a Participant must be made or authorised by a parent or legal guardian who:
(a) is at least eighteen years old and legally competent to contract;
(b) agrees to these Terms on their own behalf and on behalf of the minor;
(c) provides all consents and information lawfully required for the minor’s participation and the processing of the minor’s personal data;
(d) actively supervises the minor’s access and participation, having regard to the minor’s age and the nature of the Offering; and
(e) accepts responsibility for the minor’s account use, conduct and compliance with these Terms.
Separate parental-control features may not be available through the TagMango Platform. A parent or legal guardian must therefore independently supervise the minor’s use of the TagMango Platform, including any live sessions, community features, communications or content-sharing functions. The Operator may restrict, suspend or refuse a minor’s access where the required parental or guardian consent cannot be obtained or reasonably verified, or where continued participation may create a legal, safety or safeguarding concern.
Unless the relevant Course Page expressly states that an Offering is intended or permitted for minors, the Offering is intended only for Participants aged eighteen or above.
If you purchase on behalf of an organisation, school or other institution, you confirm that you have authority to bind that organisation and that each nominated Participant will comply with these Terms. Where any nominated Participant is under eighteen, the organisation must obtain and maintain all necessary parent or legal guardian permissions and provide reasonable evidence of them upon request. Additional corporate, institutional or group-booking terms may apply if separately agreed in writing.
You must provide complete, current and accurate information. We may request reasonable information needed to verify your identity, authority, payment, eligibility, parental or guardian status, consent or entitlement to access an Offering.
4. Account Registration and Security
Access may require a TagMango account, a verified mobile number or email address, and authentication through a password or one-time password. You are responsible for keeping login credentials and one-time passwords confidential and for activities undertaken through your account, except to the extent an unauthorised activity results from a failure for which another party is legally responsible.
An enrolment and account are personal to the registered Participant. You must not sell, transfer, share or permit another person to use your account or paid access. If you suspect unauthorised access, notify both the Operator at reachus@ashishvidyarthi.com and TagMango through its published support channel without undue delay.
Where available, we may review platform records relating to enrolment, access, progress and activity for reasonable administrative, security, refund and dispute-resolution purposes, subject to Applicable Law. Concurrent streaming or unusual device or IP activity may prompt a security review, but will not, on its own, be treated as conclusive proof of account sharing.
If reliable evidence indicates that your account is being shared or used in breach of these Terms, we may temporarily restrict access while we investigate and give you a reasonable opportunity to explain. We may terminate access for a substantiated, serious or repeated breach. We may act immediately where necessary to prevent ongoing misuse or a security risk. Any refund following restriction or termination will be determined under Section 10 and Applicable Law; it will not be automatically forfeited solely because an investigation was initiated.
5. Information About an Offering
The Course Page will ordinarily identify the principal features of an Offering, which may include its format, curriculum, instructors, price, taxes, scheduled dates, approximate duration, access period, included resources, eligibility conditions, certificate terms and any Offering-specific refund condition.
You must review the Course Page and order summary before paying. Please contact us before purchase if any material detail is unclear.
Descriptions, illustrations, trailers, extracts and promotional materials are intended to explain the nature of an Offering. They do not constitute a guarantee of a particular personal, professional, commercial, financial, educational or other result.
Curriculum structures, topics and planned live guest appearances are fluid and may change without prior notice to reflect industry relevance, guest availability or participant needs. Such changes do not, by themselves, entitle a Participant to a refund.
We may make reasonable changes to the sequence, examples, supporting resources, instructors, session format or delivery method to maintain or improve an Offering. If we make a material change that substantially reduces the core Offering purchased, the remedies in Section 10 will apply.
6. Orders and Confirmation
An order is an offer to purchase the selected Offering. Your enrolment is confirmed only after successful payment and issuance of an order confirmation, receipt or access confirmation through the TagMango Platform or by email.
We may decline or cancel an order before access is provided where there is a pricing or technical error, suspected fraud, an eligibility issue, duplicate order, legal restriction or inability to deliver the Offering. If we cancel a paid order for such a reason and you have not materially received the Offering, the amount collected for that order will be refunded.
Any special promise, discount, extension or variation is binding only if it is displayed on the Course Page or confirmed in writing by an authorised representative of the Operator.
7. Fees, Taxes, Payments and Invoices
You must pay the price and applicable taxes displayed at checkout. Prices may be displayed in different currencies depending on the country or region from which you purchase. The final amount payable, the currency in which the payment will be processed, and any applicable taxes and disclosed charges will be shown before you authorise payment. Please review the checkout currency rather than relying only on the currency shown on the Course Page.
Payments may be collected or facilitated by TagMango and one or more Payment Service Providers on behalf of the Operator. Each Payment Service Provider may apply its own terms, security procedures, exchange rates, conversion markups, processing timelines and charges.
Where the checkout currency differs from the currency of your bank account, card or payment instrument, the amount ultimately debited may differ from the checkout amount because of exchange rates, conversion markups, taxes or other charges applied by the relevant Payment Service Provider. The Operator is not responsible for such differences, charges, transaction failures or processing delays to the extent they are attributable to a Payment Service Provider and not caused by an act or omission of the Operator.
The Operator does not ordinarily receive or store complete card numbers, CVV information, UPI PINs or banking passwords. Never send such credentials to the Operator, Ashish Vidyarthi, any instructor or a community member.
A receipt or invoice may be generated or delivered through TagMango on behalf of the Operator. TagMango’s invoicing process may denominate an invoice in Indian Rupees even where the payment was processed in another currency. You are responsible for providing accurate billing information. The legal name and tax details shown on the invoice identify the supplier for that transaction.
If you are charged more than once for the same order, contact us with the transaction references. A verified duplicate collection will be refunded through the original payment channel where available. If a Payment Service Provider converts the refunded amount into another currency, the amount ultimately credited to your account may differ from the original amount debited because of the exchange rate or charges applied by that Payment Service Provider.
8. Access Period and Delivery
Access begins on the date stated on the Course Page or confirmation message. The access period is the period expressly displayed for that Offering. If no access period is displayed, access will continue for 12 months from purchase or, where a later batch or cohort commencement date is expressly stated by the Operator on the Course Page, for 12 months from that commencement date, unless the Offering is completed or access is terminated earlier in accordance with these Terms.
The expression “lifetime access”, if used, means access for as long as the relevant Offering remains actively supported and made available by the Operator through its then-current delivery platform. It is not subject to the 12-month default above, but it does not mean the lifetime of the Purchaser, Participant, instructor, Operator or any other person, and it does not guarantee perpetual availability of the Offering or operation of TagMango or any technology platform. The Operator may retire an Offering or change its delivery platform for legitimate business or operational reasons, subject to any expressly promised access period and Applicable Law.
Access may be through recorded videos, audio, text, downloadable resources, assignments, live sessions, community discussions or a combination of formats. Features may vary between Offerings.
Unless the Course Page expressly states otherwise, a Participant who misses a scheduled live session is not entitled to an individual repeat session or refund. A replay or recording is provided only where it is stated as included or we otherwise choose to provide one.
You are responsible for a compatible device, supported software, a functioning email address and mobile number, and adequate internet connectivity. Ordinary inability caused by your device, connectivity, storage, browser settings or failure to update contact information does not by itself establish non-delivery.
9. Platform Availability and Technical Issues
The Operator and TagMango use reasonable efforts to make the Offerings available, but uninterrupted or error-free access cannot be guaranteed. Maintenance, security events, internet failures, Payment Service Provider failures, third-party outages and circumstances beyond reasonable control may temporarily affect access.
For a technical issue, first follow available troubleshooting instructions and contact us with your registered details, device information, screenshots and a description of the problem. We may coordinate with TagMango where the issue concerns its platform.
Temporary downtime lasting less than 72 consecutive hours will not, by itself, constitute a breach or non-performance by the Operator or automatically entitle a Participant to a refund. Where such downtime materially affects a scheduled live session or another time-sensitive core feature, we may provide replacement access, a recording, a rescheduled session, an extension or another reasonable remedy.
If a verified platform or Operator failure materially prevents delivery for 72 consecutive hours or longer, or otherwise prevents delivery of a substantial part of an Offering, we may provide a reasonable extension, replacement access, rescheduled session, credit or proportionate refund, having regard to the nature and extent of the disruption and Applicable Law.
10. Refund and Cancellation Policy
This Section states the Operator's general refund and cancellation policy. Any different condition expressly and prominently disclosed on a Course Page before purchase will apply to that Offering, but no such condition limits a remedy that must be provided under Applicable Law.
10.1 Self-Paced or Primarily Recorded Offerings
Unless a different refund entitlement or a time-bound money-back guarantee is expressly and prominently stated on the applicable Course Page at the time of purchase, purchases of Self-Paced or Primarily Recorded Offerings are final, and no voluntary or change-of-mind refund will be available once access to the Offering or any part of its digital content has been activated or made available. This restriction does not affect any applicable Course-Specific Money-Back Guarantee, the Non-Waivable Remedies stated below or any remedy required under Applicable Law.
Course-Specific Money-Back Guarantee
Where the applicable Course Page expressly and prominently provides a time-bound money-back guarantee, that guarantee will apply only in accordance with the conditions displayed on that Course Page.
Unless the Course Page expressly provides different conditions, a Purchaser will be eligible to request a refund under such guarantee only if, at the time the request is received:
the request has been submitted within the stated guarantee period;
the Participant has accessed less than ten per cent (10%) of the Offering, as reasonably indicated by TagMango’s platform activity and progress records;
the Participant has not downloaded, copied, exported or otherwise obtained any Downloadable Materials;
no certificate of completion or participation has been issued;
the Purchaser and Participant have not materially breached these Terms; and
the request complies with the procedure specified in Section 10.7 and any additional conditions prominently disclosed on the Course Page.
The Operator may rely on TagMango’s activity and progress records and other reasonably available evidence when assessing eligibility. The Purchaser may also be required to confirm in writing that no Downloadable Materials have been downloaded, copied, exported or retained.
A money-back guarantee applies only to the specific Offering for which it was prominently displayed. It will not be implied from a guarantee, refund or concession offered for another Offering, Participant or transaction.
No Change-of-Mind Refund
Where no applicable money-back guarantee has been expressly displayed, no voluntary or change-of-mind refund will ordinarily be provided because the Purchaser or Participant:
• changes their mind or personal circumstances; • does not access, use or complete the Offering;
• lacks sufficient time to participate;
• purchases the Offering without reviewing its description, delivery language, format, access period or technical requirements;
• is dissatisfied solely because of subjective expectations inconsistent with the Offering’s advertised description;
• experiences issues arising from their device, internet connection, software, browser settings or another matter within their reasonable control; or
• has accessed only a limited percentage of the videos or other Course Content.
The Purchaser acknowledges that an Offering may provide immediate access to proprietary videos, recordings and Downloadable Materials that can be copied, downloaded, extracted or retained. Outside an expressly applicable money-back guarantee, eligibility for a refund will not be determined solely by the percentage of video content viewed or completed.
Any unauthorised downloading, scraping, copying, screen-recording, extraction, reproduction, distribution or retention of Course Content, including Downloadable Materials, constitutes a material breach of these Terms. Subject to Applicable Law, the Operator may immediately suspend or terminate the relevant account and access without refund and may exercise any other rights or remedies available to it.
Non-Waivable Remedies
Notwithstanding the above, the Purchaser may be entitled to an appropriate refund, replacement, extension, credit or other remedy where:
• a verified duplicate payment has been collected;
• the Operator cancels the Offering and does not provide a substantially equivalent replacement accepted by the Purchaser;
• access to the Offering is not provided within the stated delivery period for reasons attributable to the Operator;
• the Offering is materially defective or deficient;
• the Offering is materially different from the material characteristics or features advertised or agreed at the time of purchase; or
• a refund or other remedy is required under Applicable Law.
Any refund, credit, transfer or other concession granted voluntarily by the Operator outside an applicable guarantee or legal entitlement will be determined on a case-by-case basis. It will not constitute an admission of liability or create a precedent, waiver or continuing entitlement for any Purchaser or Participant.
10.2 Live Workshops and Cohort Programmes
A Purchaser may request a full cancellation refund until seven calendar days before the scheduled commencement of a live workshop or cohort programme, unless the applicable Course Page expressly states a different cancellation period.
For any purchase made within seven calendar days before the scheduled commencement, the sale is final and non-refundable immediately upon purchase, subject to the non-waivable remedies stated in these Terms and Applicable Law. No voluntary refund will be provided for a change of mind, scheduling conflict, personal circumstances, failure to attend, late arrival, partial attendance or inability to participate for reasons attributable to the Purchaser or Participant.
After the applicable cancellation deadline or after the Participant attends or accesses any live session, whichever occurs first, no voluntary or change-of-mind refund will be available.
At the Operator’s sole discretion, a Purchaser may be permitted a one-time transfer to a future available cohort or may receive a time-limited credit. Any transfer or credit:
• is subject to availability and any applicable price difference; • is personal and non-transferable; • must be used within the period specified by the Operator; and • is not guaranteed unless expressly stated on the Course Page or confirmed by the Operator in writing.
Failure to use an approved transfer or credit within the specified period will not create any further refund, transfer or credit entitlement.
Notwithstanding the above, an appropriate refund or other remedy will be provided where required under Applicable Law, including where the Operator cancels the programme without providing a reasonable alternative accepted by the Purchaser, fails to deliver the programme, or the programme is materially deficient or materially different from what was advertised or agreed at the time of purchase.
10.3 Memberships and Recurring Subscriptions
You may cancel a Recurring Subscription before the next billing date to stop future renewal. Cancellation does not ordinarily generate a prorated refund for a billing period that has already begun. The renewal amount, frequency and available cancellation method will be disclosed at or before checkout.
10.4 Operator Cancellation or Material Change
The Operator may reasonably reschedule, postpone or modify an Offering where necessary because of an instructor’s illness or unavailability, a venue issue, a material internet or technology outage, a security incident, insufficient enrolment, a governmental restriction, a force majeure event or any other circumstance that materially affects the safe, lawful or effective delivery of the Offering.
Where reasonably practicable, the Operator may respond to such circumstances by:
• rescheduling the affected session or Offering;
• extending the duration or access period;
• providing a recorded or replacement session;
• changing the venue or delivery method, including moving an in-person session online;
• appointing a suitably qualified replacement instructor or facilitator; or
• transferring the Participant to a substantially equivalent session, date or cohort.
A reasonable rescheduling, postponement, replacement of an instructor, change of venue or change in delivery method will not, by itself, constitute cancellation, non-performance or a material reduction of the Offering, provided that its essential nature and principal learning objectives remain substantially available.
The Participant’s enrolment will ordinarily be transferred automatically to the revised arrangement. No refund will arise automatically because an Offering or session has been reasonably rescheduled, postponed or modified.
If a live Offering is materially rescheduled and the revised arrangement is not reasonably suitable for the Participant, the Purchaser must notify the Operator within the period stated in the rescheduling notice. The Operator may, subject to availability and Applicable Law, provide:
• access to another available date or cohort;
• a time-limited credit towards another Offering;
• a substantially equivalent replacement; or
• a refund of the amount attributable to the affected undelivered portion.
If the Operator cancels an Offering and does not provide a substantially equivalent replacement or other reasonable alternative accepted by the Purchaser, the affected Purchaser will receive a refund of the amount paid for the undelivered portion.
No refund will be payable for any portion of an Offering already delivered or accessed, except where required by Applicable Law. Nothing in this Section limits any non-waivable remedy available to a Purchaser under Applicable Law.
10.5 Events Beyond Reasonable Control (Force Majeure)
The Operator is not in breach merely because delivery is delayed, interrupted or changed by an event beyond its reasonable control, including serious illness or incapacity of a key instructor, natural disaster, epidemic, government restriction, civil disturbance, labour disruption, widespread power or internet failure, cyberattack, failure of a third-party platform or another comparable event.
In such circumstances, we may reasonably reschedule the Offering, extend access, change the delivery mode or substitute a suitably qualified facilitator for a non-core session. If Ashish Vidyarthi's personal participation was a material advertised feature and cannot be provided, or if the core Offering cannot be delivered within a reasonable period, the material-change remedies in Section 10.4 will apply. Nothing in this clause removes a refund or other remedy required by law for an undelivered service.
10.6 Mandatory and Administrative Refunds
Nothing in these Terms excludes a refund or other remedy required where an Offering is materially defective or deficient, materially different from what was advertised or agreed, not delivered, or where Applicable Law otherwise requires a remedy.
Verified duplicate payments and payments collected for an order we decline will be refunded. A failed transaction that was not received by the Operator or the applicable payment system may require reversal or resolution by the relevant Payment Service Provider.
10.7 Refund Procedure
Refund requests must be emailed to reachus@ashishvidyarthi.com and must include the Participant’s registered name, mobile number, email address, Offering name, order or transaction number, payment date and reason for the request.
The Operator may request reasonable information or evidence required to verify the transaction, the grounds for the request and the person entitled to receive the refund. Failure to provide the requested information within a reasonable period may delay or prevent the processing of the request.
Where a refund is approved, the Operator will ordinarily initiate it to the original payment method within seven to ten Business Days after approval. The Purchaser acknowledges that TagMango and the relevant Payment Service Providers may require additional processing time beyond the Operator’s reasonable control.
Refunds will not be paid in cash or transferred to an unrelated person, account or payment method. Where the original payment method is no longer available, an alternative method may be used only after satisfactory verification and at the Operator’s discretion, subject to Applicable Law.
Any GST or other tax component associated with an approved refund will be treated in accordance with applicable tax laws, including any requirements concerning credit notes, refund vouchers or reversal of input tax credit. Where the Purchaser or another recipient has claimed input tax credit, the Operator may require reasonable confirmation or documentation of the corresponding reversal before completing the applicable tax adjustment.
Any tax, statutory levy or third-party charge that the Operator is legally unable to reverse, recover or refund may be excluded only to the extent permitted by Applicable Law. Nothing in this Section permits the Operator to retain any amount that is required to be refunded under Applicable Law.
11. Educational Nature and No Guaranteed Outcomes
The Offerings are for general education, personal development, communication, leadership, storytelling, performance, professional development and related learning purposes. They are not a substitute for medical, psychological, psychiatric, therapeutic, legal, tax, investment, financial, employment or other regulated professional advice.
Personal stories, exercises, examples and opinions reflect the experiences or perspectives of the relevant speaker. You remain responsible for evaluating their suitability and for your own decisions and actions.
Results depend on many factors outside our control, including prior experience, effort, participation, circumstances and implementation. We do not guarantee employment, promotion, income, business growth, relationships, health outcomes, personal transformation, public recognition or any other specific result.
Testimonials, case studies and examples describe individual experiences. They are not promises that every Participant will obtain the same or similar outcome.
If an Offering includes physical, vocal, emotional or reflective activities, participate within your abilities and seek suitable professional advice where appropriate. Stop any activity that causes significant discomfort or appears unsafe for you.
12. Certificates
A certificate may be issued only where expressly included and where the Participant satisfies the published completion or participation criteria.
Unless expressly stated otherwise, a certificate is a private certificate of participation or completion. It is not a university degree, government-recognised qualification, professional licence or assurance of employment or advancement.
We may withhold or revoke a certificate obtained through impersonation, plagiarism, account sharing, manipulation of completion records or another material breach, subject to a reasonable review of the circumstances.
13. Ownership of Course Content
The Course Content made available in connection with the Offerings is owned by or lawfully licensed to the Operator, Ashish Vidyarthi and/or the relevant rights holders.
Names, professional identity, image, likeness, voice, signature, performances and other personality or publicity attributes of Ashish Vidyarthi and any other instructor remain protected and may not be exploited without express written permission from the relevant rights holder.
Purchase gives the registered Participant a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable right to access and use the Course Content solely for the Participant's own non-commercial learning during the applicable access period. No ownership or commercial right is transferred.
14. Prohibited Use of Course Content and Identity
Unless expressly permitted in writing by the relevant rights holder, you must not:
copy, reproduce, download through unauthorised means, record, photograph, screen-record, publish, broadcast, translate, adapt, distribute, sell, license, rent or commercially exploit any Course Content;
share login credentials or enable access by an unregistered or unauthorised person;
remove, obscure, disable or circumvent any watermark, copyright notice, access control, digital-rights-management measure or technological restriction;
upload or supply Course Content to any file-sharing, social-media, messaging, course-reselling, piracy or similar service;
use Course Content, an instructor’s materials or Participant Content submitted by another person to create, support or improve a competing course, publication, commercial product or service;
scrape, crawl, index, harvest or systematically extract any content or data from an Offering or community;
use any Course Content, name, image, likeness, voice, performance or recording to train, fine-tune, test, benchmark or supply a dataset for any artificial-intelligence or machine-learning system;
create or distribute any synthetic voice, avatar, digital replica, deepfake, impersonation or misleadingly altered depiction of Ashish Vidyarthi, an instructor or another Participant; or
represent or suggest any sponsorship, endorsement, employment, agency, partnership or affiliation that has not been expressly authorised in writing.
Limited quotation for genuine review, criticism or another use permitted by Applicable Law is not prohibited, provided that it is accurate, proportionate and properly attributed and does not disclose Course Content or Downloadable Materials not made available for public access, confidential information or personal information.
Any actual or threatened commercial leak, unauthorised distribution, piracy, scraping or artificial-intelligence exploitation may cause serious and irreparable harm for which monetary compensation alone may be inadequate. Upon detecting or reasonably suspecting such conduct, the Operator may, subject to Applicable Law:
immediately suspend or terminate the relevant account and access without refund;
preserve and use relevant platform, access and transaction records for investigation and enforcement;
issue takedown, blocking, preservation or disclosure requests to platforms, intermediaries and service providers;
seek urgent interim or permanent injunctive relief without prejudice to any other remedy;
claim damages, reasonable compensation, an account of profits or any other monetary remedy available under law; and
recover investigation, enforcement and legal costs to the extent awarded or otherwise recoverable under Applicable Law.
15. Live Sessions and Recordings
An Offering may include live or interactive sessions. The schedule, capacity and mode of participation may be changed where reasonably necessary, with appropriate notice where practicable.
If a session will be recorded, a notice will be provided before or at the beginning of the session. A recording may capture display names, chat messages, audio, video or contributions of participating individuals. Where required, an appropriate consent mechanism will be provided. Participants who do not wish to appear should keep their camera and microphone off, avoid posting identifying information in the chat and contact us before participating; however, some highly interactive activities may not be suitable for anonymous participation.
Where a Participant is under eighteen, any consent required for the Participant’s identifiable inclusion in a recording must be provided by the Participant’s parent or legal guardian.
Recordings created for delivery of an Offering may be made available to authorised Participants for the stated access period. You must not independently record, reproduce or redistribute a session without written permission.
We will not use an identifiable Participant's testimonial, close-up image, personal story, voice or performance in public advertising merely because the Participant attended a session. A separate permission or release will be obtained where legally required for promotional use. Incidental inclusion in a wide group or event image will be handled in accordance with the notice given and Applicable Law.
16. Participant Submissions
You retain ownership of your Participant Content. You confirm that you have all rights, licences, consents and permissions necessary to submit it and that it does not infringe any other person’s rights or violate Applicable Law.
You grant the Operator and its service providers a limited, non-exclusive, worldwide and royalty-free licence to host, store, reproduce, display, transmit and moderate Participant Content only as reasonably necessary to provide, administer, secure and improve the relevant Offering, respond to you and comply with law. This operational licence ends when the content is deleted or no longer reasonably required, except for lawful records, security copies and material already incorporated with separate permission.
Participant Content will not be used as a public testimonial or advertisement solely under this operational licence. Public promotional use of identifiable Participant Content requires separate permission where required by law.
17. Communities and Participant Conduct
Learning communities are intended to support respectful discussion and participation. You must not:
threaten, harass, bully, stalk, discriminate against or deliberately humiliate another person;
disclose another person's personal, private or confidential information without permission;
impersonate another person or misrepresent qualifications, identity or affiliation;
solicit money, promote unrelated products, send spam or recruit members for an unrelated business without written permission;
introduce malware, attempt unauthorised access, disrupt the platform or evade access restrictions;
infringe intellectual-property, privacy, publicity or contractual rights;
encourage illegal activity or violate Applicable Law; or
disrupt sessions or repeatedly interfere with other Participants' learning.
Participants may share personal experiences in a community. Other Participants are prohibited from taking or sharing screenshots, recordings or personal information without permission. Nevertheless, no online community can guarantee that another Participant will preserve confidentiality. Exercise judgment and do not disclose information that would cause harm if repeated or copied.
We may moderate, restrict or remove content and may mute, suspend or remove a Participant where reasonably necessary to protect safety, rights, the learning environment, the platform or legal compliance.
18. Communications
We, TagMango and relevant service providers may send transactional communications reasonably necessary for enrolment and delivery, such as one-time passwords, payment confirmations, schedule notices, access instructions, security alerts, support responses and material service changes.
Promotional email, SMS, WhatsApp or telephone communications will be sent in accordance with Applicable Law and the preferences or consent collected from you. You may opt out of promotional messages using the unsubscribe mechanism provided or by writing to reachus@ashishvidyarthi.com. Opting out of marketing will not prevent essential transactional or legal communications.

19. Third-Party Services and Links
An Offering may include or link to TagMango, payment services, videoconferencing services, messaging applications, social networks, downloadable applications or external resources. Third parties may apply their own terms and privacy policies.
We are responsible for selecting and using service providers with reasonable care to the extent required by law, but we do not control every independent third-party service. You should review the applicable third-party terms before using an optional external service.
A link or reference does not by itself constitute endorsement of all third-party content. We are not responsible for a Participant's independent transaction or interaction with an unrelated third party.
20. Suspension and Termination
We may temporarily restrict or terminate access where reasonably necessary because of non-payment, fraudulent activity, account sharing, piracy, harassment, a safety risk, unlawful conduct, infringement of rights, a serious or repeated breach, a legal requirement or termination of the relevant access period.
Where a breach is capable of remedy and does not create an immediate risk, we may provide notice and a reasonable opportunity to correct it. We may act immediately in cases involving safety, fraud, security, illegality, piracy, threats, serious harassment or material harm.
Termination for a Participant's material breach does not ordinarily create a right to refund. This does not exclude remedies that cannot lawfully be waived.
Provisions concerning intellectual property, confidentiality, payment obligations, lawful records, disclaimers, liability, indemnity and disputes survive termination to the extent their nature requires.
21. Disclaimers
To the maximum extent permitted by law, the Offerings and Course Content are provided on an "as available" basis. We do not promise that every Offering will be suitable for every person, that access will always be uninterrupted, or that every error will be corrected immediately.
We do not endorse or accept responsibility for independent statements, advice, products or services offered by Participants or unrelated third parties merely because they appear in a community or linked resource.
Nothing in these Terms excludes an express commitment made on the Course Page, responsibility imposed by Applicable Law, or a consumer remedy that cannot lawfully be excluded.
22. Limitation of Liability
To the maximum extent permitted by law, the Operator, Ashish Vidyarthi, instructors and the Operator's directors, partners, officers, employees, consultants and authorised contractors will not be liable for indirect, incidental, special, punitive or consequential loss, loss of opportunity, loss of anticipated profit or loss caused by a Participant's unauthorised use, independent decision, device failure or breach of these Terms.
To the maximum extent permitted by law, the aggregate contractual liability of the Operator and the persons listed above arising from a particular Offering will not exceed the amount actually paid to the Operator for that Offering by the affected Purchaser.
The limitations in this Section do not apply to liability that cannot be excluded or limited under Applicable Law. They do not prevent a consumer from seeking a remedy available under mandatory consumer-protection law.
23. Participant Indemnity
To the extent permitted by law, you agree to indemnify the Operator, Ashish Vidyarthi and their authorised personnel against third-party claims and reasonable losses directly resulting from your unlawful commercial exploitation of Course Content, infringement of third-party rights, fraudulent activity, deliberate security interference, unlawful Participant Content or serious violation of another person's privacy or safety.
This indemnity does not apply merely because you make a genuine complaint, request a lawful refund or exercise a statutory right. We will take reasonable steps to mitigate covered losses and will not settle a claim imposing an admission or non-monetary obligation on you without appropriate consultation where practicable.

25. Governing Law and Disputes
These Terms are governed by the laws of India.
Before beginning formal proceedings, the parties should ordinarily attempt in good faith to resolve the matter through the grievance process for at least thirty days, unless urgent relief or a statutory deadline requires earlier action.
Subject to mandatory consumer-protection jurisdiction and other non-waivable rights, the competent courts at Mumbai, Maharashtra will have jurisdiction over disputes arising from these Terms.
Nothing in these Terms restricts a consumer's right to approach a competent Consumer Commission, regulator, statutory authority or other forum available under Applicable Law.
26. Changes to These Terms
We may update these Terms to reflect changes in an Offering, the platform, technology, security practices or Applicable Law. The updated version will display a revised "Last Updated" date.
Material changes affecting an existing paid Offering will be communicated by a reasonable method and will not retrospectively remove an accrued statutory right. Changes ordinarily apply prospectively. If a change materially and adversely affects an existing Offering, we will provide an appropriate remedy where required by law.
27. General Provisions
If any provision is held unlawful or unenforceable, it will be limited or severed to the minimum extent necessary and the remaining provisions will continue.
Failure to enforce a provision on one occasion is not a waiver of that provision or any other right.
The Operator may use service providers and authorised personnel to perform its obligations. You may not transfer an enrolment or contractual right without written permission, except where Applicable Law requires otherwise.
These Terms do not create a partnership, employment, franchise or agency relationship between a Participant and the Operator, Ashish Vidyarthi, an instructor or TagMango.
Electronic records, platform logs, order confirmations and communications may be used as evidence to the extent permitted by Applicable Law.
